Afriforum’s lawyer Adv. Mark Oppenheimer and EFF leader Julius Malema were in court this week in the continuing ‘hate speech’ civil lawsuit launched by the lobby group over the singing of ‘Shoot the Boer.’ Malema was charged in his capacity as EFF leader alongside MP Dr. Mbuyiseni Ndlozi. AfriForum wants them all to publicly apologise and pay a total of R500 000 to a non-governmental organisation combating hatred. The applicant presented case studies of farm killings to support their claim. According to Oppenheimer, there was sufficient proof that the singing of the song had provoked the death of white farmers. However, according to expert witness Prof. Elizabeth Gunner, an African literature expert who opposes criminalising anti-apartheid songs like “Dubul’ibhunu,” even the most inflammatory South African struggle songs have a place in our democracy.
Prof. Thabo Ditsele, Gabriel Crouse from the Institute of Race Relations, and Legal Analyst Lerato Moela, debate this further.
