PREVIEW to the ITALY DIGITAL NOMAD WORK VISA! | Work remotely? Get a visa to live & work in Italy!

Italy is following in the footsteps of many countries and will soon be offering the Digital Nomad Work Visa!! Here is a PREVIEW of what we know about the law so far:

1. Not subject to the flusso! (annual quota of work permits)
2. To apply, you must work:
• for a company
• for your own business
3. You must have
• technical or professional skills
• fully virtual job
4. You will need to apply for an entry visa from the Italian Embassy or Consulate.
5. You will need to have:
• proof of a minimum income
• a clean criminal record
• health insurance

****NOTE! For a good, expat long-term medical insurance, I recommend this one:

6. You will need to obtain a permesso di soggiorno, or permit of stay
7. The initial period will be one year, renewable.
8. You will need to pay Italian taxes
9. You will have to pay contributions to INPS for social security.

A couple of tax regimes could apply to digital nomads and ease the impact of Italian taxes:
1. Regime Forfetario
• Flat tax of 5% on 78% of your income.
• You can’t deduct business-related expenses.
• You can earn up to 65,000 euros per year.

2. Impatriates Regime
• Taxes on only 30% of your income
• 10% if you live in certain regions in the south of Italy:
• Sicily, Sardinia, Calabria, Abruzzo, Molise, Campania, Puglia, and Basilicata

I spoke to Colin Jamieson of for clarity on what’s happening with the law:

“Fundamentally what we have is a new couple of articles in the Italian Immigration Code. This has not been updated yet on the Italian Government Official Gazette website; that may take some time.
• The Italian Consolidated Immigration Code is Legislative Decree 25 July 1998 n. 226.
• Art 27 is the section that has been amended with the Digital Nomad Work Visa.
• The amendment itself was contained in Law 28 March 2022 no. 25, in art 6 quinquies.
That law is converting to a Decree-Law, which is not the same as a Legislative Decree. A Decree Law requires approval/ratification by Parliament; otherwise it will not take effect. This process is known as “conversion”. So the March 28 law was fundamentally drafted to “convert” (ie. ratify) the Decree Law of January (DECRETO-LEGGE 27 gennaio 2022, n. 4) which will be a modification to the 1998 Immigration Law.

The law is published, but for the time being it is just of framework authorization by Parliament. Before anyone can apply for one of these visas, we need to wait for the Interministerial Decree that will implement the new rules and then I suspect for the actual application forms or website to be distributed or made ready.

The March 28 Law was drafted to “convert” (ie. ratify) the Decree-Law of January (DECRETO-LEGGE 27 gennaio 2022, n. 4) containing a series of state aid measures unconnected with the Digital Nomad Work Visa. The Digital Nomad Work Visa legislation was slotted into the Law during the Parliamentary “conversion” process, and since it consists of a modification to the 1998 Immigration Code it actually has nothing to do with the January Decree-Law.

A further decree from the relevant Ministries (Interior, Labour, Foreign Affairs and Tourism) is expected within a month from now, to complete the details of the visa and define implementation matters.”
